Intellectual Property Policy

Beta Beta. Last updated 26 October 2026

We respect intellectual property and expect others to. This page explains how our games are made and how rights holders can contact us.

Our policy on originality

Every Eracade game is an original work made in-house. Some are inspired by classic genres or play styles, but none use another company's names, characters, artwork, music, sound effects or code. Game mechanics and genres are ideas, not owned expression, and we take care that our expression is our own.

Fan and inspired works

We do not host fan games, clones or user-uploaded games, and we do not accept submissions that use third-party characters, names or assets. If you think one of our games copies protected expression, tell us exactly what and where, and we will look into it seriously. Sharing a genre or an era's look is not, by itself, infringement.

Notice of claimed infringement

To report copyright infringement, send a written notice to legal@eracade.com (a postal address for legal notices is available on request) that includes:

  1. your physical or electronic signature (or that of the person authorised to act for the rights holder);
  2. identification of the copyrighted work you claim is infringed;
  3. identification of the material you claim is infringing, with the URL or enough detail for us to find it;
  4. your name, address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorised to act on its behalf.

Knowingly false notices may expose the sender to liability. We may remove or disable access to the material, may pass the notice to the person responsible, and may keep a record of it.

Counter-notice

If material was removed and you believe that was a mistake or that you have the right to use it, send a counter-notice to legal@eracade.com that includes:

  1. your physical or electronic signature;
  2. identification of the material removed and where it appeared before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
  4. your name, address and telephone number, a statement that you consent to the jurisdiction of the courts for your address (or, if outside the United States, any judicial district where we may be found), and that you will accept service of process from the person who sent the original notice.

If we receive a valid counter-notice we may forward it to the original complainant. If they do not tell us within 10 business days that they have started legal action, we may restore the material.

Trademarks

"Eracade", "Unflatline" and our logos are trademarks of their owners. Do not use them in a way that suggests affiliation or endorsement. If you believe something on Eracade infringes your trademark, send legal@eracade.com your mark and registration details (if any), the page concerned, and why you believe it infringes. Eracade is independent and is not affiliated with any console maker or game publisher.

Repeat infringers (for future user content)

Eracade does not host user-generated content today. If we add features where people can upload or publish content, we will end, in appropriate circumstances, the accounts of users who are repeat infringers, and we will update this policy before those features launch.
